Field Sobriety Tests

Have you failed a field sobriety test?

Law enforcement officers will often use a field sobriety test to determine if a person is intoxicated. According to the National Highway Traffic Statistics Association, a standard field sobriety test (SFST) has been discovered to have an accuracy of 95% in its ability to determine if a person is intoxicated. If you have been charged with a DUI after failing a field sobriety test, you may be able to prove your innocence with the help of a Los Angeles criminal defense lawyer.

How a Field Sobriety Test Works

When an officer pulls a driver over, he or she may check to see if the driver smells of alcohol or if the driver's speech is slurred. If the officer suspects that a driver is intoxicated, he or she may then administer a field sobriety test.

The three most common tests in the state of California are the walk and turn, the one leg stand and the horizontal gaze nystagmus:

  • Walk and turn - walk in a straight line, heel to toe, turn and walk the other way
  • One leg stand - stand on one leg, with the other raised slightly off the ground
  • Horizontal gaze nystagmus - follow a light or object with your eyes

The accuracy of the SFST is an essential part of a prosecutor's case. However, the SFST's are based on a theory that everyone who is drunk is therefore uncoordinated. If a driver fails any component of a field sobriety test, it is assumed that their BAC is above 0.08% or that they must be impaired by something. These tests may not be a fair indication of a driver's ability to drive, and a DUI attorney from our firm may be able to help you fight a DUI charge from a failed field sobriety test.
